Terms and Conditions of Sale

Article 1 — Purpose and scope

These Terms and Conditions of Sale ("Terms") govern all sales of products and services concluded between Afasin (hereinafter "the Seller") and any non-professional buyer (hereinafter "the Buyer") via the afasin.com platform.

Afasin is an Afro-Caribbean marketplace offering food, cosmetics, textile, cultural and craft products originating from Africa, the Caribbean and the African diaspora in Europe.

Any order placed on afasin.com implies full and unreserved acceptance of these Terms. The Buyer declares having the legal capacity to enter into a contract.

Article 2 — Products

Products available for sale are described as accurately as possible (photographs, features, composition, origin). However, photographs are for illustrative purposes only.

Afasin acts as an intermediary between the Buyer and partner sellers (hereinafter "Third-Party Sellers"). Each Third-Party Seller is responsible for the accuracy of information relating to their products.

Products are offered subject to availability. Should a product become unavailable after the order is confirmed, the Buyer will be informed by email and may choose between a full refund or store credit.

Article 3 — Prices

Prices are shown in euros (€) inclusive of all taxes, excluding delivery charges. Applicable VAT is the rate in force on the day the order is placed.

Afasin reserves the right to change its prices at any time. Products are invoiced at the price in effect at the time the order is confirmed.

Promotions or discount codes may be offered. These offers are valid for the duration and under the conditions stated when they are published.

Article 4 — Orders

Placing an order follows these steps:

  • Selecting products and adding them to the cart
  • Reviewing the cart and entering delivery details
  • Choosing a payment method and confirming
  • Order confirmation by email

The order is definitively confirmed once payment is received. A confirmation email summarising the order is sent to the Buyer within 24 hours.

Afasin reserves the right to cancel any suspicious order or order involving proven fraud, without this giving rise to any compensation.

Article 5 — Payment

Payment is due immediately upon ordering. Accepted payment methods are:

  • Credit/debit card (Visa, Mastercard, American Express) via Stripe
  • PayPal

Transactions are secured by SSL/TLS encryption. Afasin does not store any of the Buyer's banking details.

If payment is declined by the financial institution, the order is automatically cancelled.

Article 6 — Delivery

Products are delivered to the address provided by the Buyer when ordering. Delivery times are given as an indication only:

  • Mainland France: 3 to 7 working days
  • French overseas territories: 7 to 15 working days
  • Europe: 5 to 10 working days

Delivery charges are calculated based on weight, volume and destination, and are clearly shown before the order is confirmed.

Afasin cannot be held liable for delivery delays caused by the carrier. The Buyer must report any parcel not received within 30 days of the order date.

Upon receiving the parcel, the Buyer must check the condition of the products. Any issue (damaged parcel, missing product) must be reported to the carrier and to Afasin within 48 hours.

Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Buyer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

To exercise this right, the Buyer must notify their decision by email to contact@afasin.com before the deadline expires.

Products must be returned in perfect condition, in their original packaging, to the address provided by Afasin. Return shipping costs are borne by the Buyer.

The refund will be issued within 14 days of receiving the return, using the same payment method used for the order.

Exceptions: The right of withdrawal does not apply to perishable products, products unsealed by the Buyer for hygiene or health reasons, or digital content.

Article 8 — Legal warranties

All products sold benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In the event a defect of conformity is identified within 24 months of delivery, the Buyer may request replacement or repair of the product, or, if this is not possible, a refund.

Article 9 — Liability

Afasin cannot be held liable for indirect damages resulting from the use of the products, nor for inaccurate information provided by Third-Party Sellers.

Afasin's liability is limited to the amount of the order concerned.

Article 10 — Personal data

Data collected when ordering is processed in accordance with our Privacy Policy. It is used to process orders, manage customer accounts and, with consent, send marketing communications.

The Buyer has the right to access, rectify, delete and port their data by contacting contact@afasin.com.

Article 11 — Mediation and disputes

In the event of a dispute, the Buyer should first contact Afasin's customer service at contact@afasin.com for an amicable resolution.

If no satisfactory solution is reached within 30 days, the Buyer may make free use of the competent consumer mediation service or the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Article 12 — Governing law

These Terms are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the French courts, unless mandatory legal provisions state otherwise.
